Regression: Unnecessary context menu is seen on 'No recent items' screen

Chrome Version:73.0.3673.0/11604.0.0 dev channel Peppy,Kip,Paine
OS:Chrome OS

What steps will reproduce the problem?
(1)Sign into user >> Press overview button to get 'No recent items' screen
(2)Right click and observe unnecessary context menu(Please refer video)

Actual:Unnecessary context menu is seen on 'No recent items' screen
Expected: When context menu comes 'No recent items' screen should go off since we can open set wallpaper

This is a Regression issue as same works fine in 68.0.3440.134/10718.106.0

I think this is after the overview focus window focus got delayed till after animations, but there are no animations here. But i do not think it is very high priority.
