The devices reported in this bug do not use V4L2 for video decode, while the fix mentioned in comment #6 suggests a fix that is specific to V4L2. Reopening. Is there any new failure today? The fix #6 makes sense, even though they are V4L2 specific. The V4L2 change breaks even for intel devices, since intel devices tries to initialize V4L2VDA/V4L2SVDA first. If something wrong happens in their initialization, somehow software fallback is used.

I am seeing a flaky test on Eve-tot-chrome-pfq-informational for video_ChromeHWDecodeUsed. However the exception is slighlty different:
