Chrome Version: Not in the official chrome release yet

What steps will reproduce the problem?
(1) make a html file that contains a <video> tag with disabled controls playing audio-only content 
I have used the following to reliably reproduce the problem
<video src="http://www.sousound.com/music/healing/healing_01.mp3"></video>
(2) open the said html file with chromeium


What is the expected result?
-since the control is disabled, we shouldn't see the display of control


What happens instead?
-we will see the control's background displayed.
(In other words, when control is enabled, only the buttons disappear, but the background of the control still remains)

using the bisect tool, we found the CL that introduced the bug
