Going forward devices should be using DRM atomic APIs by default. Investigate if this flag can be removed in favor of using the DRM capability check to decide between legacy and atomic path. (May need to update certain devices)

Alternatively flip the switch such that DRM atomic is enabled by default and the legacy path needs a flag to force legacy mode.
