Currently cookies can be set in the background any time a page is prerendered. As prerender is deprecated (crbug.com/678332) and AMP/AGSA begins to use the background tab mechanism instead of prerender (crbug.com/710720), cookies will be able to be set in the background only through the background tab mechanism.

The privacy whitepaper will need to be updated to reflect this.
