Non-Regression : Unnecessary 'Sorting' option is seen in empty Downloads Folder

Issue description

Chrome Version: 57.0.2987.100/9202.51.0 beta-channel Daisy & Candy
OS: Chrome

What steps will reproduce the problem?
(1)Sign into User -> Click on Launcher available at L.H.S of Shelf
(2)Select "Files" to open Downloads -> Now observe Sorting option available at 'Data modified' (Please refer screenshot)

Expected: 'Sorting' option should be enabled if there are more than 2 files or folders
Actual: Instead 'Sorting' option is seen in empty Downloads Folder

This is Non-Regression issue  seen from M-53

Note: 'Sorting' option is even seen for other options Name,Size,Type

Status: WontFix (was: Assigned)
This is WAI.
The indicator shows the current sorting option, which will be applied not only for the current empty directory, but also for other directories which can have many files.
It's consistent behavior as others (e.g. Mac Finder as far as I checked)
