Seems like until the video element visibility is detected by the viewport intersection, we should be fine, because according to Yuri the tab is not reported to be in the background if it's being captured.

This issue has been Available for over a year. If it's no longer important or seems unlikely to be fixed, please consider closing it out. If it is important, please re-triage the issue.
