chrome://inspect incorrectly reports disabling chrome data saver even when you are in an incognito window

Issue description

UserAgent: Mozilla/5.0 (X11; Linux x86_64) AppleWebKit/537.36 (KHTML, like Gecko) Chrome/49.0.2623.75 Safari/537.36

Steps to reproduce the problem:
1. visit a page on your phone in an incognito tab 
2. inspect said page via chrome://inspect
3. switch to the network tab and note how it says to consider disabling chrome data saver even though it is disabled

What is the expected behavior?

What went wrong?
This message should be hidden if I am in an incognito window or I have disabled it because the message makes me think that I have messed something up.

It incorrectly reported Data Saver to me as enabled when i had it disabled. And it was for a month at least.
