"new incognito window" and "new tab" menus are disabled if a window isn't open

Issue description

Chrome Version       : 6.0.427.0 dev
OS version               : 10.6.3

What steps will reproduce the problem?
1. Start chrome, close all chrome windows.
2. Press cmd-shift-n to open a new incognito window

What is the expected result?
It opens

What happens instead?
Nothing happens. The menu item for New Incognito Window is greyed out. The same applies for the "new tab" menu item - it's useful to be able to open a "new browser to go somewhere" by pressing cmd-t with muscle memory without having to think whether there is already a window open or not.
 
Forgot to note, I think this is a recent regression (at least cmd-t).

Safari handles cmd-t with windows closed too.
